| PLEASE NOTE that FLSA lawsuits are different than regular class actions because individuals must take steps to affirmatively join or "opt in" to the FLSA lawsuit through the filing of a "Consent to Join" document with the Court. Eligible individuals who do not file Consents to Join are not part of the FLSA collective action, are not bound by the outcome of the FLSA claims lawsuit, and receive none of the damages awarded either through a settlement or a verdict at trial under the FLSA. |
| If you have questions about your eligibility to join this action or would like to complete an initial Consent to Join form, please contact Paul Hurcomb or Scott Johnson at (719) 634-5700 or e-mail the firm. |
| Should I Join the Lawsuit even though a Settlement has been Reached? |
| Yes. If the Court does not approve the settlement, the lawsuit will continue. Filing your consent to join the suit will preserve your claims in the lawsuit. However, joining the lawsuit is not the same as filing a claim to share in the settlement. |
| On April 21, 2008, the Court granted preliminary approval to the settlement. On May 19, 2008, the court-approved notice of settlement and claim forms were mailed to potential class members. In order to file a claim, you will need review the information contained in the notice, complete the claim form, and return it to the Settlement Administrator. You may also access the notice and claim form at www.cspdovertimesettlement.com. |
